Distance Sales Contract
PARTIES AND PURPOSE
This agreement is made between the party renting a villa/apartment/holiday home (hereinafter referred to as the “CUSTOMER”) and the party leasing said villa/apartment/holiday home: Villadiyarı Turizm Ticaret Ltd. Şti., a company duly established under the laws of the Republic of Turkey, located at Cevizli Mah. Bayraktar Sk. No: 9 D:62, tax number 9251255881 (hereinafter referred to as “VILLADIYARI”), for the purpose of renting the property for a predetermined period.
Customers who make a reservation via our website, by phone or by email for any villa listed under VILLADIYARI are deemed to have accepted the following terms in advance.
Any breach of the following terms grants VILLADIYARI the right to unilaterally cancel the reservation, demand that the customer vacate the villa, retain the deposit, damage fee or rental payment, and claim any outstanding rental payments.
RESERVATION AND PAYMENT
Reservations for our villas can be made in advance via the reservation form on our website, SMS, telephone, or email.
VILLADIYARI, after receiving the desired rental dates and the customer's contact and billing information, performs the preliminary booking.
Following the preliminary booking, VILLADIYARI requires a deposit of 20% or 30% of the total rental fee (the exact amount may vary depending on the villa).
Once the deposit is paid within 1 (one) business day, the villa will be reserved in the customer’s name. The amount due and our bank account details will be provided via email, SMS, or phone.
The deposit can be paid via bank transfer, EFT, or credit card through the website within 1 business day.
A written confirmation of the reservation will be sent to the customer within 1 business day after receipt of the deposit.
This confirmation will specify the total rental fee, the deposit amount received, the rental dates, and the time and date of the deposit payment.
If the deposit is not paid, VILLADIYARI reserves the right to cancel the pre-reservation without notifying the customer and to accept other bookings for the villa.
The remaining rental amount is payable via cash, bank transfer, or EFT upon check-in and after the villa has been inspected.
As the villa is delivered furnished, a damage deposit determined by the villa owner will be collected to cover potential damages, breakages, or losses. This deposit is payable in cash, via bank transfer, or EFT upon check-in. If no damage or loss is found after inventory inspection at check-out, the deposit will be refunded.
To avoid inconvenience, these payments must be ready in cash, via transfer or EFT, on the check-in day.
CHECK-IN / CHECK-OUT
On the first day of the reservation, the earliest check-in time to the villa is 16:00 (4:00 PM) and the latest is 22:00 (10:00 PM).
The CUSTOMER may not check in outside these specified hours. If the CUSTOMER arrives after the latest check-in time, they will only be allowed entry to the villa the next morning, at the start of working hours (09:00 AM) of VILLADIYARI personnel.
VILLADIYARI cannot be held responsible for any issues, such as lack of overnight accommodation or difficulties in finding an alternative place to stay, caused by the CUSTOMER’s arrival outside of the designated check-in hours.
The CUSTOMER is solely responsible for finding and covering the cost of overnight accommodation if they arrive outside of permitted hours.
On the last day of the reservation, check-out must be completed by 10:00 AM at the latest, regardless of the villa’s location.
Any issues, losses, or inconveniences resulting from the CUSTOMER’s failure to vacate the property by 10:00 AM are the full responsibility of the CUSTOMER. The CUSTOMER will be liable for any financial damages incurred by VILLADIYARI due to such delays.
We kindly remind both parties to plan their travel schedules in accordance with these times to avoid any inconvenience.
If the CUSTOMER wishes to check out earlier than planned, they must notify VILLADIYARI at least 24 hours in advance.
In cases where the villa cannot be inspected due to high occupancy, the damage deposit will be returned to the CUSTOMER via bank transfer to an account they provide. Transfer fees will be deducted from the deposit amount.
If the CUSTOMER voluntarily leaves the villa earlier than agreed, no portion of the damage deposit will be refunded.
VILLA CAPACITY
Under no circumstances will guests be allowed to exceed the maximum occupancy indicated on our website for each villa, or the number of guests specified at the time of booking. This includes children and infants (0–6 years old).
If the CUSTOMER wishes to change the number of guests after the reservation has been confirmed, they must submit a written request to VILLADIYARI. Such changes will only be accepted subject to the villa’s capacity and at the discretion of VILLADIYARI.
VILLADIYARI reserves the right to charge an additional fee for such changes.
After check-in, no guests other than those listed on the reservation will be allowed to stay in the villa. If unauthorised guests are found staying in the property, VILLADIYARI reserves the right to request that they vacate the premises, cancel the reservation in full, or demand that the villa be vacated immediately, without waiting for the end of the rental period. VILLADIYARI may also demand full payment of the rental fee and charge additional fees.
The reservation is made based on the CUSTOMER’s declaration, and the CUSTOMER accepts full responsibility for the accuracy and completeness of the information they provide.
VILLA CLEANING / MAINTENANCE AND EXTRA EXPENSES
The rental prices for daily, weekly, or monthly bookings include a pre-arrival cleaning.
For stays of two weeks or longer, one weekly cleaning, including the change of towels, sheets, etc., is also included. Any additional cleaning services or linen/towel changes requested beyond this will be subject to an extra charge.
Pool and garden maintenance is carried out every morning at an early hour. In case of any technical problems during the rental period, they will be resolved by the property owner. VILLADIYARI is not responsible for these issues but will assist in their resolution.
To perform periodic maintenance of the pool, garden, and other fixtures, the assigned staff may need to enter the garden or interior of the villa. The CUSTOMER must allow access when necessary to ensure these services are carried out properly.
Unless otherwise specified on the villa’s detail page on our website, the rental fee includes the cost of electricity, water, bottled gas, pool lighting, internet connection, and air conditioning usage.
Note: Not all villas have pool lighting, internet access, or air conditioning as standard features. We recommend that you carefully read the villa features section before making a booking.
PETS / SMOKING
Unless otherwise stated, pets are strictly not allowed in the villas.

PRICES
The villa rental prices stated on our website are daily, weekly, or monthly rates.
Deposit payments can be made via bank transfer, EFT, or the Credit Card payment system available on our website.
RESERVATION, PAYMENT, CANCELLATION AND REFUND CONDITIONS
For any cancellation or change requests regarding a reservation, the CUSTOMER must make the request via their personal reservation panel. The login details for this panel are sent to the CUSTOMER via email and SMS once the booking is completed. Requests made verbally (e.g. over the phone) will not be accepted under any circumstances.
Requests for changes to reservation dates or services must be submitted to VILLADIYARI no later than 30 days before the start of the stay. Change requests are subject to the availability of the accommodation and the discretion of the partner facility. If a change cannot be made, the CUSTOMER cannot hold VILLADIYARI liable or raise objections.
Cancellation Policy:
If the CUSTOMER cancels the reservation within 24 hours of confirmation, the full deposit will be refunded unconditionally.
(Note: This does not apply if the check-in date is within 21 days.)After the first 24 hours following confirmation, no refunds will be given under any circumstances.
Cancellations must be submitted in writing via email or fax.
If the reservation is cancelled 0–7 days before the start of the stay, or if the guest fails to show up, 100% of the total booking fee will be charged.
If the reservation is cancelled 14–21 days before the start of the stay, 50% of the total booking fee will be charged.
If the CUSTOMER fails to pay any compensation owed under this agreement, VILLADIYARI reserves the right to collect such amounts through legal means, including official notices and enforcement proceedings. Any legal costs incurred in the process (e.g. lawyer fees, notary fees, enforcement and court fees) will also be added to the amount owed and claimed from the CUSTOMER.
EXCEPTIONAL CIRCUMSTANCES
If the CUSTOMER presents official documentation for certain exceptional circumstances that are beyond their control, such as serious health risks, epidemics, war, civil unrest, terrorism, natural disasters, or the death of a first-degree relative, the deposit already paid will be held as credit to be used for a future booking, and the relevant amount will be deducted from the total of the new reservation.
According to Article 15(g) of the Distance Contracts Regulation, prepared pursuant to Articles 48 and 84 of Law No. 6502 on the Protection of Consumers, the right of withdrawal does not apply to contracts regarding the provision of accommodation, transportation of goods, car rental, food and drink supply, and leisure activities to be carried out on a specific date or within a specific period.
DAMAGE DEPOSIT
A damage deposit will be collected from the CUSTOMER, the amount of which varies depending on the characteristics of the villa. This amount will be specified in writing in the confirmation document sent during the reservation process.
The deposit must be paid by the CUSTOMER on the day of check-in, via cash, bank transfer, or EFT. Upon check-out, if the villa and its inventory are found to be in the same condition as delivered, the deposit will be refunded in full.
If the CUSTOMER checks out earlier than agreed or if the exit inspection cannot be carried out due to high occupancy, the deposit will be refunded via bank transfer to an account provided by the CUSTOMER. If any damage is found and its cost exceeds the deposit, the CUSTOMER will be required to cover the additional cost. Otherwise, legal action may be taken.
If the villa is left in a condition that requires extra cleaning due to excessive mess or negligence, the property owner may deduct part or all of the damage deposit. VILLADIYARI cannot be held responsible for such deductions.
SWIMMING POOLS
The temperature of the swimming pools may vary depending on weather conditions and the season. The CUSTOMER cannot hold VILLADIYARI responsible for being unable to use the pool due to cold water.
If the CUSTOMER wishes to learn about the weather forecast for their rental dates, they may consult the Turkish State Meteorological Service website or contact the service by phone.
HEATED SWIMMING POOLS
Not all villas are equipped with a pool heating system. If available, this feature is clearly stated on the villa’s detail page.
Some heated pools are included in the rental price, while others are subject to an additional fee—again, this will be clearly stated on the detail page.
The temperature of heated pool water typically ranges from 26°C to 29°C. It is important to note that this is not comparable to hot spring or spa temperatures.
When booking a villa with a heated pool and paying for this service, CUSTOMERS must take the expected water temperature into account. Complaints such as “the water is not warm enough” will not be accepted, and no refunds will be issued.
VILLADIYARI cannot be held responsible if the CUSTOMER is unable to use the pool for such reasons. Additionally, since the heating systems run on electricity, VILLADIYARI will not be held responsible for power outages that may cause the water to cool down.
OUR RESPONSIBILITIES AND WARRANTY
VILLADIYARI is responsible for delivering the villa to the CUSTOMER at the agreed date and time, clean and ready for use.
If there are any broken or non-functioning items or issues upon arrival, the CUSTOMER must immediately notify VILLADIYARI and request that the problems be resolved.
VILLADIYARI will notify the villa owner or relevant service provider and ensure the issue is resolved within 48 hours at most.
VILLADIYARI is not directly responsible for resolving the issue but will assist in coordinating its resolution.
VILLADIYARI cannot be held responsible for problems that were not reported at the time of occurrence.
VILLADIYARI acts as an intermediary between the CUSTOMER and the villa owner, and therefore, the responsibility for resolving issues lies with the owner.
VILLADIYARI is not responsible for any accidents, illnesses, injuries, drownings, deaths, theft, fires, etc., that occur due to the CUSTOMER’s own actions or responsibilities.
Likewise, VILLADIYARI is not responsible for any problems related to services provided by third parties during the CUSTOMER’s stay, such as transportation, tours, shopping, food and beverages, entertainment, travel, or guidance services.
Once the CUSTOMER has checked out, they cannot claim any rights or request refunds for issues not reported during the stay.
INVOICING AND TAX
None of the villas listed on VILLADIYARI’s website are owned by VILLADIYARI. Each villa belongs to different individuals, institutions, or companies.
VILLADIYARI acts only as an intermediary (commission agent) for these rentals. Therefore, VILLADIYARI issues an invoice only for the commission earned from the CUSTOMER.
This means that VILLADIYARI issues an invoice only for the portion of the fee it retains as its commission. The remainder of the payment, which belongs to the villa owner, is not invoiced by VILLADIYARI. The responsibility for invoicing the remaining amount lies with the villa owner.
VILLADIYARI is only responsible for invoicing its own earnings. It is not responsible for invoicing on behalf of third parties and cannot be held liable for such matters.
CUSTOMER RESPONSIBILITIES
CUSTOMERS are responsible for using the villa, pool, garden furniture, and all electrical/electronic devices and furnishings delivered in working condition in a clean and proper manner.
All kitchenware provided clean must be returned in the same condition.
On the day of check-out, the villa must be left with all rubbish removed and dishes washed.
If the villa is left excessively dirty, a cleaning fee will be deducted from the damage deposit.
The CUSTOMER must notify VILLADIYARI of any damage caused during their stay.
If any property is lost or damaged, the cost will first be deducted from the damage deposit. If the cost exceeds the deposit, the CUSTOMER will be required to pay the remainder via cash, bank transfer, or EFT.
In addition, the CUSTOMER and their party must abide by social and moral norms, avoid making loud noise, playing loud music, and refrain from engaging in any behaviour that is illegal or disturbs the peace. If such complaints are received, VILLADIYARI reserves the right to ask the CUSTOMER to vacate the villa immediately, even before the rental period ends.
VILLADIYARI does not guarantee 100% privacy in villas marketed as “conservative” (i.e. pool not visible from outside). Ensuring privacy is the CUSTOMER’s own responsibility. VILLADIYARI cannot be held liable for such matters.
FORCE MAJEURE
In circumstances deemed to be force majeure, VILLADIYARI reserves the right to unilaterally terminate this agreement without incurring any legal liability.
Events that fall under force majeure include, but are not limited to:
War, threat of war, uprisings, strikes, terrorist activity, epidemics, technical issues affecting transportation, infrastructure or construction works conducted by public authorities or municipalities, government-imposed regional restrictions, and any unforeseen or uncontrollable situations.
COMPLAINTS
Customers must report any complaints during their stay to VILLADIYARI immediately.
The reported issue will be investigated by VILLADIYARI staff and necessary action will be taken promptly.
Complaints made after the stay has ended will not be taken into consideration, and VILLADIYARI cannot be held responsible for such matters.
SECURITY AND PRIVACY POLICY
VILLADIYARI will not disclose personal information to any company or third party, except as specified in this Privacy Policy and Terms of Use.
VILLADIYARI never sells the personal information of its visitors, registered users, or partners to third parties.
“Personal information” refers to all data that can be used to identify a user, such as name, surname, address, phone number, and email address.
VILLADIYARI may use this information internally to create user profiles and conduct statistical research, and may share it with third parties only for these specific purposes.
VILLADIYARI undertakes to treat all personal data as confidential, to consider it a duty of confidentiality, and to take all necessary measures to prevent unauthorised use or disclosure.
In the event of a cyberattack that compromises personal data despite VILLADIYARI’s security measures, VILLADIYARI cannot be held liable.
The website www.villadiyari.com.tr may contain links to other websites. VILLADIYARI is not responsible for the privacy practices or content of those external websites.
VILLADIYARI may record and use IP addresses to identify users or gather demographic information.
OTHER IMPORTANT INFORMATION
VILLADIYARI is not responsible for poor road conditions (e.g. unpaved, steep, slippery roads) leading to the villa that are beyond its control.
VILLADIYARI cannot be held liable for accidents or any negative events occurring en route to the villa.
If any material used in the construction or landscape of the villa (e.g. cedar, pine, plastic items, plants, etc.) causes physical or psychological discomfort, VILLADIYARI bears no responsibility.
All of our villas require a private vehicle for access. Transportation to the villa is the CUSTOMER's own responsibility.
The CUSTOMER may arrange taxis, transfer vehicles, or rental cars from third parties. VILLADIYARI is not involved in or responsible for such services.
If the CUSTOMER is dissatisfied with the geographical location of the villa, VILLADIYARI cannot be held responsible. Villa locations are shown approximately on Google Maps.
VILLADIYARI is not liable for any damage to vehicles during access to the villa, whether private or rented.
If a CUSTOMER's vehicle has low ground clearance, weak engine power, or if the CUSTOMER lacks driving experience, and they cannot access the villa because of this, VILLADIYARI will not be responsible for any resulting issues.
The “distance table” on the villa’s detail page provides approximate distances to key locations. Slight inaccuracies are possible. The CUSTOMER accepts this.
The airport listed on the villa’s detail page is the closest one, which could be Dalaman, Bodrum, Antalya, etc. The CUSTOMER should confirm the correct airport with VILLADIYARI. VILLADIYARI is not responsible if the CUSTOMER books a flight to the wrong airport.
Distance information for amenities like the nearest restaurant, market, beach, or public transport is provided for convenience. VILLADIYARI is not liable if any of these services are closed.
VILLADIYARI is not responsible for any accidents such as drowning or injury in or around the pool.
Hot water in the villas is typically supplied by 160-litre solar water tanks. If hot water runs out due to excessive use, the CUSTOMER is responsible.
None of the villas include food or drink. No meals, breakfast, or buffet services are provided. All food provisioning is the CUSTOMER’s responsibility.
VILLADIYARI is not liable for poor or unavailable mobile phone signal or mobile internet service at the villa.
Even if you’ve paid by credit card, EFT, or wire transfer, do not purchase flights or transport tickets unless you have received a confirmation email and reservation document from VILLADIYARI. Without these, the reservation is not valid, and VILLADIYARI will not be responsible for resulting losses.
VILLADIYARI is not responsible for accidents, fires, gas leaks, deaths, or injuries resulting from customer negligence or service outages caused by utility companies.
The villa listed on the website is the exact property. Complaints such as “it looked bigger/nicer on the site” will not be accepted, and no refunds will be issued for such reasons.
VILLADIYARI is not responsible for any inconvenience caused by natural conditions or weather.
VILLADIYARI is not liable for animal bites, stings, or related incidents.
Villas are only considered “conservative” if explicitly stated. If no such statements exist on the villa’s page, the CUSTOMER cannot claim otherwise or request cancellation.
The CUSTOMER is responsible for pest or insect problems caused by leftover food or rubbish attracting ants or other animals.
VILLADIYARI is not responsible for illness or allergic reactions caused by pool or shower water, including chlorine allergies.
Animal farming (e.g. cows, chickens, etc.) may occur nearby. VILLADIYARI is not responsible for noise or odours from these activities.
Reservation cancellations due to work-related leave cancellations, wedding postponements, etc., are not considered force majeure, and all standard rental conditions remain in effect.
By accepting these terms, the CUSTOMER agrees that VILLADIYARI has the right to terminate the agreement and demand full payment if the CUSTOMER attempts to cancel the contract by citing any of the above reasons.
DISPUTES
For any legal disputes arising from this agreement, the Istanbul Anadolu Courts and Enforcement Offices shall have jurisdiction.
By making a reservation for any of our villas, the CUSTOMER is deemed to have accepted all of the above terms in full. Violation of any of these terms grants VILLADIYARI the right to unilaterally cancel the reservation, withhold any payments, and demand the entire rental amount.
